Department Of National Defense: Trillianes Has no Record Of Application For Amnesty

MAKATI RTC Branch 150, Philippines September 14, 2018 – The Regional Trial Court Makati branch 150 did not indulge on the motion of the Department of Justice to issue a warrant of arrest and hold departure order to Senator Antonio Trillianes IV in connection with his rebellion case in 2011 of such court.

Judge Elmo Alameda give five days on both sides to submit their reply on their arguments and a chance to submit an additional documentary evidence.

Today, the prosecution submits a certificate from the ‘Department of National Defense’ which confirms that Trillianes has ‘no record’ of application for amnesty and also, there are no records of interview of the senator in some media that he didn’t admit his guilt.

Meanwhile, Trillianes’ defense filed a certified true copy of documents that verify its application for amnesty and also the media records of his application.

Judge Alameda required the prosecution that in spite of the loss of records of the Department of National Defense, they have to prove that Trillianes had never ever applied for amnesty. Judge Alameda also asked Trillianes’ side for an additional evidence by requesting an affidavit from Colonel Josefa Berbigal if Senator Antonio Trillianes IV really applied for amnesty.

This is the second time the court did not indulge the motion of the Department of Justice just like yesterday September 13 in Makati RTC Branch 148.

On the other hand, as we notice, the Department of National Defense didn’t have the record of Senator Trillianes’ admission of guilt that suppose to be covered by some media. All he possesses is the document for application of amnesty including the media record of his application. But where is the record that shows his admission of guilt?
