Application Form Is Defective: Acting Prosecutor Fadullon On Trillianes Amnesty Case


MANILA Philippines October 5, 2018 – An interview to Acting Prosecutor Fadullon was held today after the hearing of Makati RTC Branch 148 on Senator Trillianes case about the amnesty.

On the interview, Fadullon stated that on the Proclamation 75, there should be an admission of guilt – “when you admit guilt, you don’t admit guilt to an incident. An incident is not an offense, so as the consequence of that incident, there are crimes for which they were charged. Yun yung sinasabi ng batas na yun ang iaadmit mo na kung saan ka guilty (The law stated that you have to admit your crimes. On which you are guilty in particular)."



Fadullon insisted that the form never stated that there is a charge for coup d’état and rebellion on Oakwood and Manila Peninsula Siege which it should be charged against the mutineers in the first place. This is what the prosecution is pointing out.

A reporter asked Fadullon if the application is wrong or invalid in the first place. Fadullon answered that apart from the fact, their opinion about the form itself is "defective". He added – “The thing there is, it could have been corrected IF they are able to show that there is a total admission. The offense itself is a serious one for them to make it just like a “check-the-box” and “fill in the blanks” form. They also said that it includes narration of facts pertaining to their involvement and participation, but these are all testimonies. They cannot show the documents which prove that there is an existing document that is included in the application form.”



Fadullon clarifies that the Proclamation 572 pertains to Senator Trillianes only and not to his fellow soldiers that are involved in the rebellion. So he does not want to speculate as far as the application of other involved soldier who also applied for amnesty.

After the statement Fadullon, a follow-up question from a reporter asked if the amnesty is defective, the amnesty of other involved soldier would be revoked next tp Trillianes. Fadullon just answered again – “Like I said, we will not speculate on that. What we are talking here is about a specific individual. So we’re confining ourselves to the proclamation 572 pertains to the declaration of voiding of the application of Senator Trillianes."
